Whittlebury Park have submitted an appeal on the grounds of non-determination against West Northants Council. Planning Application Reference WNS/2022/2060/MAO
In many cases when there is non determination the council could be argued to be at fault as they sat on it too long, lost the file, couldn’t be bothered, etc. In this case the argue that the application is deficient and does not have the correct level of detail and supporting documentation to be able to determine it.
Appeals come in three sorts:
Written Representations – where an Inspector looks at the written documents only and makes a decision – usually for small scale developments.
Hearing – where the Inspector sits, in say the council offices, listens to both sides arguments as well as documents, more akin to the planning committee
Public Enquiry – everyone comes with the KC and have a bun fight.
Strangely this was scheduled as a written reps appeal that I found odd given the scale of proposed development. I asked WNC to have this reviewed. Today we have a result that this has been changed to an hearing with a proposed date of 1 May in The Forum in Towcester.
The appeal reference is APP/W2845/W/23/3326508
